By accessing or using the Site or purchasing our Services, you agree to be bound by these Terms. If you do not agree, do not use our Site or Services.

2. Business Use & No Legal Advice Disclaimer

Our Site and Services are intended for business use only. We do not offer our Services to consumers acting for personal, family, or household purposes.

No Legal Advice. Although our materials may contain legal information, they do not constitute legal advice and may not have been reviewed by an attorney licensed to practice in your jurisdiction. Akamai HR Solutions, LLC is not a law firm, and no attorney–client relationship is created by your use of our Site or Services. Laws may change or apply differently to your business. All deliverables are customized digital products provided via our client portal or secure delivery method. Once delivered, they are considered complete.

4. Payment & Refund Policy

4.1 Payment Terms

Payment in full is required before any work begins. We accept payment through approved payment methods listed on our Site or invoices.

4.2 Refunds

You may cancel your order and receive a full refund any time before final review and delivery of your handbook to your client portal, or any digital products delivered via email.

No refunds will be issued after final review and delivery of your customized digital handbook, or other digital products, except where required by law.

5. Intellectual Property

All content, designs, processes, and materials provided by Akamai HR Solutions are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use deliverables solely for your internal business purposes.

You may not:

  • Reproduce, distribute, or sell our materials
  • Share deliverables with third parties outside your organization without our written consent

6. Acceptable Use

You agree not to:

  • Use our Site or Services for unlawful purposes
  • Attempt to gain unauthorized access to our systems
  • Misrepresent your identity or affiliation
  • Upload malicious code or files

7. Third-Party Platforms (SixFifty Disclaimer)

Some Services may be delivered via third-party platforms such as SixFifty. When you access these platforms, your use is governed by their terms and privacy policy. Akamai HR Solutions is not responsible for the actions or omissions of third parties.

8. Limitation of Liability

To the maximum extent permitted by law, Akamai HR Solutions, LLC, its officers, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Site or Services, even if advised of the possibility of such damages.

In no event shall Akamai HR Solutions’ total liability for all claims arising out of or related to the Site, Services, deliverables, or these Terms exceed the total amount you paid to Akamai HR Solutions for the specific Service or deliverable giving rise to the claim.

This limitation shall apply regardless of the legal theory asserted, whether in contract, tort (including negligence), strict liability, or otherwise. Some jurisdictions do not allow certain limitations; in such cases, this clause applies to the maximum extent permitted by law.

9. Indemnification

You agree to defend, indemnify, and hold harmless Akamai HR Solutions, its officers, employees, and agents from any claims, damages, or expenses (including attorney’s fees) arising out of your breach of these Terms, misuse of our Services, or violation of law.

10. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

11. Dispute Resolution – Arbitration, Small Claims Carve-Out, Class Action Waiver

11.1 Binding Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. Arbitration shall be held in Bakersfield, California.

11.2 Small Claims Carve-Out

Either party may bring an individual action in small claims court in Kern County, California, for disputes within the court’s jurisdiction.

11.3 Class Action Waiver

All claims must be brought in an individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding.

11.4 Finality

The arbitrator’s award shall be final and binding, and judgment may be entered in any court with jurisdiction.

12. Force Majeure

We are not liable for delays or failure to perform due to causes beyond our reasonable control, including acts of God, labor disputes, government actions, or internet outages.

13. Changes to Terms

We may update these Terms at any time by posting a revised version on our Site with the “Last Updated” date. Continued use of the Site or Services constitutes acceptance of the changes.

14. Electronic Communications

By using our Site or Services, you consent to receive communications electronically. You agree that electronic agreements, notices, and records have the same legal effect as paper versions.
